HIPAA – Health Insurance Portability and Accountability Act of 1996

Consumers who receive Medicaid funded services may be individuals who are served in Community Inclusion Programs (CIP), sheltered employment, individual or group supported employment, or at commercial or government sites as part of the JWOD / Ability One program.

Only three of the four regulations apply to Didlake, since we do not bill for Medicaid services electronically.

Privacy procedures apply to consumers who also may be employees.

Policies and procedures are examples of administrative safeguards. Another example, are red books which are red folders included in consumer’s human resources records and contains personal health-related information. Human Resources must remove this before an employee’s record is shared with others.

Some of our consumers are also employees. Although HIPAA regulations do not require Didlake to protect the following information, it is protected by our business associates. Within Didlake, such information is only shared internally on a need-to-know basis for employment reasons only. We all have the right to privacy and need to respect the rights of others.
